General Terms and Conditions

This Privacy Policy informs about the methods of protecting personal data of the Site Users (“Users”) of www.electromobilitypoland.pl, hereinafter referred to as the “Site”.
The content of the Site pages is the property of the Data Controller - ElectroMobility Poland S.A. with its registered office in Warsaw, Al. Jerozolimskie 81 and is legally protected.
The Internet Site is of an informational nature. We make every effort to ensure that the content of the site is as up-to-date as possible. Access to the Site may be obtained using the most popular web browsers - Internet Explorer, Chrome, FireFox, Opera, Safari, and others. The Site does not contain content that violates the rights of third parties or applicable laws. In particular, the site does not contain content that causes or constitutes a threat to the privacy or security of any persons, contains information promoting illegal activities or behaviours that are offensive, threatening, indecent, defamatory or libellous, inciting racism, harassment on ethnic, cultural or religious grounds, promoting or facilitating criminal activities, violating third party rights, including intellectual property rights, or constituting any other form of violation of legally protected goods.

Data collection

In accordance with the practice adopted by most websites, ElectroMobility Poland S.A. stores HTTP requests directed to our server. The viewed resources are identified by URL addresses. The exact list of information stored in the WWW server log files is as follows:

• public IP address of the computer from which the request came (this may be directly the user’s computer)
• client station name - identification carried out by the HTTP protocol if possible,
• username provided in the authorisation process,
• time of request arrival,
• first line of HTTP request,
• HTTP response code,
• number of bytes sent by the server,
• URL address of the page previously visited by the user (referrer link) - in case the transition to our page was made through a link,
• user browser information,
• information about errors that occurred during HTTP transaction execution.

This data is not associated with specific persons browsing the Site. To ensure the highest quality of the site, we occasionally analyse log files, among others to: determine which Site pages are visited most often, which web browsers are used, whether the page structure contains errors.

Cookie Mechanism

Cookies are information installed on the user’s device that are sent by the website while it is being visited by the user. The information usually contains data regarding the Site’s domain, data storage time and a unique number. Cookies are used primarily to properly display the content found in the Site, remember search history, and ensure high quality services by ElectroMobility S.A. The user may change cookie settings at any time. The scope of changes and related options depend on the specific web browser software and can be modified through it. Leaving cookie settings unchanged means consenting to placing cookies on the user’s device, thus allowing the Administrator access to related data. Cookies are used solely for internal purposes of site optimisation in terms of performance and for statistical analyses.
Changing cookie handling settings in web browser software may cause difficulties in using the Site or its selected functionalities. Cookies used by the Site may include:
• user input cookies;
• security cookies, e.g. used to detect authentication abuse (user centric security cookies);
• session cookies, including multimedia players (e.g. video player cookies), for the duration of the session (multimedia player session cookies);
• persistent cookies used to personalise the User interface (user interface customisation cookies);
• cookies used to monitor website traffic, i.e. data analytics, including cookies.

Additionally, we inform that through our website data is collected using tools provided by Google Analytics. Google Analytics collects its own cookies, independently of ElectroMobility Poland S.A.
Website users can adjust cookies and data collected by Google Analytics using features such as: cookie settings, User-ID identifier, Data Import and Measurement Protocol platform.

Pixel Mechanism

Through social media plugins Facebook, LinkedIn, Twitter, these sites record actions taking place on our Site. These events are pre-defined by these sites and allow them to monitor conversions, optimise their actions and create audience groups (e.g. people interested in electromobility). We receive such data, but these are not user data, only information about the number of people who reached our Site through social media. The collected information is not personal data.

Liability

This Privacy Policy does not cover any information regarding services or goods of entities other than ElectroMobility Poland S.A. We are not liable for the actions or omissions of Site users.
We reserve the right to introduce changes, withdraw or modify functions or properties of the websites constituting the Site, as well as cease operations, transfer rights to the Site and perform any legal actions permitted by applicable law. Our actions cannot violate user rights.

Personal Data Processing Rules

1. The Controller of data submitted through www.electromobility.pl and via other communication channels, including in particular electronic mail, is ElectroMobility Poland SA with its registered office in Warsaw at Al. Jerozolimskie 81.

3. Personal data provided through the website will be processed based on our legitimate interest which is maintaining contact with persons visiting our site in accordance with Article 6(1)(f) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, “GDPR”. Personal data will in this case be processed to respond to the submitted question and to take steps aimed at establishing cooperation.
4. In case of contacting the Controller via electronic mail, the address of which appears in the Contact section on the Website or contact form, personal data will be processed for the period necessary to respond to the submitted inquiry or notification and archived for the period necessary to process the inquiry or notification. After this period, personal data will be deleted unless their processing will be necessary for the implementation of cooperation, then the data will be processed until the contract is completed, for the period specified by tax and accounting regulations, and in case of pursuing claims under the concluded contract, until their limitation period.
5. In case of contacting the Controller through email addresses of employees or representatives of the Controller, personal data will be processed pursuant to Article 6(1)(f) of the GDPR for the purpose of maintaining contact. The data will be processed for the period necessary to provide a response. If the contact is related to a contract concluded with the entity you represent, the data may also be processed for the purpose of implementing cooperation, pursuing claims, defending against these claims, as well as fulfilling the legal obligation incumbent on the Controller, which can be considered as processing invoices, maintaining accounting books and tax documentation (Article 6(1)(c) of the GDPR). In this case, the data will be processed until the contract is completed, for the period specified by tax and accounting regulations, and in case of pursuing claims under the concluded contract, until their limitation period.
6. The obtained personal data will be transferred to processors who provide services to ElectroMobility Poland S.A., including entities cooperating with ElectroMobility Poland, e.g. in the scope of providing IT services.
7. As a general rule, your personal data will not be transferred outside the European Economic Area (hereinafter referred to as: EEA). However, taking into account the services provided by subcontractors of the Controller in carrying out support for ICT services and IT infrastructure, the Controller may outsource certain IT activities or tasks to recognised subcontractors operating outside the EEA. This may result in your data being transferred outside the EEA. Individual countries outside the EEA where your personal data will be processed hold an adequacy decision issued by the European Commission and ensure appropriate level of data protection (in line with EEA standards). However, in the case of processing of the data in the territory of countries that do not hold an adequacy decision issued by the European Commission, in order to ensure such protection, the Controller concludes agreements with recipients of your personal data. These agreements are based on standard contractual clauses issued by the European Commission in accordance with point (c) of Article 46(2) of the GDPR. A copy of the standard contractual clauses can be obtained from the Controller. The method used by ElectroMobility Poland S.A. to safeguard your data is in line with the principles laid down in Chapter V of the GDPR. Therefore, you may request further information on the safeguards applied in this regard, obtain a copy of these safeguards and information on where they can be accessed.
8. In connection with our processing of your personal data, you have the right to:
a. request from the Controller access to personal data and the right to rectify, erase or restrict processing and the right to data portability;
b. lodge a complaint with the Personal Data Protection Office when you consider that the processing of your personal data violates data protection regulations;
c. object to the processing of personal data - you have the right to object at any time - for reasons related to your particular situation - to the processing of your personal data based on Article 6(1)(f). The Controller may no longer process such personal data unless it demonstrates compelling legitimate grounds for the processing which override your interests, rights and freedoms or grounds for the establishment, exercise or defence of legal claims.
9. Providing personal data is voluntary but necessary to respond to the submitted inquiry or notification. The data subject is required to provide an email address or phone number, and the consequence of not providing the data will be the inability to receive a response to the submitted inquiry or notification.
